Consultation on the draft merchant shipping (prevention of pollution by garbage from ships) regulations 2020

The Maritime and Coastguard Agency is seeking your views on the draft Merchant Shipping (Prevention of Pollution by Sewage from Ships) Regulations 2020.

The draft Regulations will bring UK legislation up to date with the latest requirements of Annex IV (Prevention of Pollution by Sewage from Ships) of the International Maritime Organization’s (“IMO”) International Convention for the Prevention of Pollution from Ships (“MARPOL”).  

Please could you review the consultation document, draft legislation, Marine Guidance Note, and De-minimis Assessment and provide your views on the following:

1. whether the draft Regulations transpose the MARPOL Annex IV requirements accurately and appropriately;
2. whether the use of an ambulatory reference provision to incorporate future technical amendments to MARPOL Annex IV into UK law automatically as they come into force internationally is appropriate;
3. where the Administration’s discretion is permitted, whether the draft Regulations would adequately transpose the MARPOL Annex IV requirements;
4. whether the proposed offences and penalties (which are consistent with those contained in the 2008 Regulations) are appropriate; and
5. whether the proposed guidance to accompany the Regulations is adequate and in the right format.
